Actor Darius McCrary was arrested by U.S. Border Patrol on an out-of-state felony warrant at the U.S.-Mexico border earlier this month and is currently being held in a San Diego jail without bail.

McCrary, known for his role as Eddie Winslow on the sitcom “Family Matters,” has not yet been sentenced and is not eligible for release. He was arrested on October 5th.

His online booking information lists him as a “fugitive under arrest,” according to documents obtained by People. The San Diego court website shows McCrary is a defendant in an unresolved criminal case.

The 49-year-old actor was detained at the U.S.-Mexico border in San Diego on an outstanding warrant for failing to appear in court in Michigan for unpaid child support, Entertainment Weekly reported.

McCrary's first court date is set for October 15th.

The actor's agent, Anne Barlow, said in a statement: “He did not know at the time that there was a warrant and would have issued one otherwise.”

“He was going to Tijuana, Mexico, in partnership with a real estate development company that was building homes for the homeless in Tijuana. Mr. McCrary was there to speak encouragement and light to the homeless,” she continued.

“The failure to appear that gave rise to the warrant was only due to Oakland County sending a notice of appearance to his post office box and giving him only three days to appear in court.”

Mr Barlow claimed that Mr McCrary had not checked his post office box as often as he normally did because he was ill.

She argued that when McCrary opened the notice, he had already missed the deadline and that “the judge was immediately informed by a doctor's note that he had COVID-19.”

McCrary has been facing a long legal battle over his estranged wife, Tammy Browner. According to People magazine, McCrary nearly finalized her divorce from Browner in February 2019.

The divorce judgment grants Browner, a former player for the Harlem Globetrotters, full legal and physical custody of the former couple's daughter Zoe.

McCrary was ordered to attend alcohol/drug abuse and abuser intervention classes within 12 months and was required to enroll in and complete a series of parenting classes. He was also ordered to submit to two random drug tests within 60 days of his sentencing.

The Young and the Restless actor was ordered to pay child support of $1,366 per month, which is a base amount of $916 plus $415 in child support.

Browner filed for divorce from McCrary in March 2017, citing irreconcilable differences.

Several years ago, McCrary faced allegations of domestic violence and child abuse. In March 2018, Browner claimed the actor “partially dislocated my daughter's arm.”

According to court documents, Browner attached medical records documenting Zoe's injuries.

She apparently told doctors that Zoe was taken to the toilet by Mr McCrary and that Mr McCrary “grabbed her arm”.

The actor denied the accusations, claiming he “just grabbed her with one hand to lift her up and then quickly grabbed her other hand.”

Zoe was reportedly diagnosed with “pull elbow,” a condition in which a child's elbow is partially dislocated.

In February 2017, Browner accused McCrary of abusing both her and Zoe and was granted a restraining order against her.

In these court documents, Ms. Browner recalled one particular incident in which she claimed that Ms. McCrary held her daughter over boiling water and said that she wished she had never given birth to her daughter.

Browner also claimed that the actor frequently spanked his daughter and sometimes tied her arms while she ate.

She also recalled the incident that led to her obtaining a restraining order. On February 10, 2017, McCrary said she began throwing picture frames and other objects around her home, some of which came close to hitting her then-infant daughter. She also accused him of hitting her in the head with his forearm.

Mr. Browner claimed that Mr. McCrary regularly drank and used drugs and became violent when inebriated.

At the time, a judge ruled in Browner's favor and ordered McCrary to move out of the family home and stay at least 300 feet away from her and her daughter.
